A gap between your old residence permit and your new one is common for international students in Germany, and during that gap your continued stay is already lawful automatically, by operation of law, provided you applied in time. The Fiktionsbescheinigung the Ausländerbehörde then issues does not create that legal status, it documents and proves it.  Leaving the country is rarely the hard part. Getting back into Germany afterward is where the document is actually tested, since it is your Fiktionsbescheinigung, not your outbound ticket, that a border officer checks when you land back from India. The honest answer to whether re-entry works depends entirely on which type of Fiktionsbescheinigung you hold, and treating all versions of the document as interchangeable is where students run into trouble.

1. Understanding What a Fiktionsbescheinigung Actually Confirms

A Fiktionsbescheinigung is not a residence permit  and, just as importantly, it is not what makes your stay legal. When you apply in time for an extension or a new title, the law itself (§ 81 AufenthG) treats your existing status as continuing: this 'fiction' of continued lawful residence arises automatically, by operation of law, the moment you file a valid application not when the certificate is printed or handed to you. The Fiktionsbescheinigung is simply the official document that records and proves this already-existing status while the Ausländerbehörde processes your application, whether for an extension, a change of purpose, or a switch to a post-graduation permit. Because it is issued under different paragraphs of the Aufenthaltsgesetz depending on your circumstances, two students sitting in the same lecture hall can hold documents with entirely different re-entry rights.

1.1 Two Legal Bases That Decide Whether You Can Come Back

The paragraph printed on your certificate determines everything.

i. Fiktionsbescheinigung under Section 81(4): issued when you already held a valid residence permit or national visa and applied for an extension or a new permit before the old one expired. This type generally permits travel abroad and re-entry to Germany, provided the certificate remains valid on the exact date you cross back into the country, not merely on the day you left.

ii. Fiktionsbescheinigung under Section 81(3) Satz 1: issued when you entered Germany and applied for a residence title while your stay was still considered legally permitted, but without holding a prior residence permit that continues under fiction. This version does not guarantee re-entry once you leave the Schengen Area, and in most cases the Ausländerbehörde will not let you back in on this basis alone.

The difference between these two decides whether your return flight from India lands you back at your university or in a visa application queue at a German consulate abroad.

Two practical consequences follow. First, because the fiction is triggered by your timely application and not by the paper, your legal status does not lapse just because the certificate is delayed, is being reissued, or is briefly out of your hands, the continuation is already in force by law. Second, because the certificate only evidences that status, you must still carry it (with your passport and expired permit) to prove your right at the border: the officer relies on the document to confirm a status that legally already exists.

2. What This Means Specifically for a Trip to India

2.1 Confirm the Exact Wording on Your Certificate

Do not rely on what a friend's certificate said or what worked for someone else's case. Read the paragraph reference and any remarks field on your own Fiktionsbescheinigung, since some caseworkers add explicit restrictions such as "kein Anspruch auf Wiedereinreise" (no entitlement to re-entry). If your certificate does not clearly state that re-entry is permitted, treat the trip as high risk until you get written confirmation.

2.2 India-Side Entry Requirements Are a Separate Matter

Indian citizens travel on their Indian passport and generally do not need a visa to enter their own country, though OCI or PIO cardholders should confirm their card is current.

3.1 The Validity Window That Determines Re-Entry

A Fiktionsbescheinigung that was valid when you flew out can expire while you are still in India, and the date that counts at the border is the date of your return, not your departure. Build in a buffer before you book: if your certificate expires close to your planned return date, or if your Ausländerbehörde appointment for a decision falls during your trip, request an extension or written guidance before you leave rather than after you land back in Frankfurt or Munich.

3.2 How the EU Entry/Exit System Affects Fiktionsbescheinigung Holders

Europe introduced the EU Entry/Exit System (EES) in stages from October 2025, with full rollout across Schengen borders completed in April 2026. EES records fingerprints and a facial image for non-EU short-stay travelers each time they cross an external Schengen border, replacing manual passport stamps. Long-term residence permit holders are meant to be exempt from this short-stay registration, but a Fiktionsbescheinigung is a paper bridging document rather than a standard residence card the system is built to read automatically. In practice this means a Bundespolizei officer will likely need to review your Fiktionsbescheinigung, expired permit, and passport manually to confirm your exemption, rather than the automated gate handling it. Plan for extra time at re-entry and keep every relevant document out and ready, not packed away in checked luggage.

3.3 If Your Application Is Decided While You Are Abroad

A residence permit decision does not pause because you are visiting India. If your application is approved while you are away, your Fiktionsbescheinigung may no longer be the right document to re-enter on, and you should ask your Ausländerbehörde how to proceed, since some offices require you to collect the new eAT card in person. If your application is rejected while you are abroad, the fiction of continued stay, which by law lasts only until the authority decides, ends with that decision , and re-entry to Germany without a new visa becomes far more complicated. i. Your valid passport with any prior German visa or residence permit sticker still visible.

ii. The Fiktionsbescheinigung itself, valid through your planned return date, not just your departure date.

iii. Your expired residence permit or previous visa, since the fictional continuation only makes sense alongside the document it is extending.

v. 5. What Happens If You Re-Enter on the Wrong Basis

Leaving Germany on a Fiktionsbescheinigung that does not cover re-entry, or letting the certificate expire while you are still in India, can mean your legal stay in Germany ends the moment you try to cross back in. I am writing to explain my residence and immigration status in connection with my temporary departure on DD.MM.YYYY and my re-entry into Germany on DD.MM.YYYY. Both dates fall within the validity of my provisional residence certificate (Fiktionsbescheinigung).

I. Facts

I held a residence permit under Section ___ of the German Residence Act (AufenthG), which expired on DD.MM.YYYY. II. Legal effect of the fiction (Section 81 (4) AufenthG)

Where a foreign national applies, before the expiry of their residence title, for its extension or for the issuance of another residence title, the previous residence title is deemed to continue in effect from the time of its expiry until the immigration authority decides (Section 81 (4) sentence 1 AufenthG). Where the application is filed in due time, this continuation takes effect by operation of law. I am therefore to be treated as if I still held the previous residence permit; my residence is lawful throughout.

III. Legal effect of the certificate (Section 81 (5) AufenthG)

The Fiktionsbescheinigung is the certificate to be issued under Section 81 (5) AufenthG documenting the effect of my application. It is not a residence title in its own right, but evidences the fiction that has already taken effect by operation of law. It is valid together with my valid passport, which is available.

IV. Entitlement to depart and re-enter

With a Fiktionsbescheinigung under Section 81 (4) AufenthG (continuation fiction), departure abroad and subsequent re-entry into Germany are permitted, provided the certificate is still valid at the time of re-entry. This reflects the uniform administrative practice of the German immigration authorities. My departure (DD.MM.YYYY) and my re-entry (DD.MM.YYYY) fall within the validity of the certificate; re-entry will take place directly into Germany.
